What is a cookie banner and why do you need one?
Under Article 5(3) of the ePrivacy Directive, every website must obtain user consent before storing non-essential cookies. The EU Court of Justice's Planet49 ruling (2019) confirmed that pre-ticked checkboxes do not constitute valid consent: the user must actively opt in.
A compliant cookie banner must offer clear choices: accept all, reject all, and granular category settings. It must block all non-essential cookies until the user gives consent, and allow easy withdrawal of consent at any time.
